Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with Neverland Store you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Neverland Store retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party with whom you have contracted. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

Pricing and Availability

While we try and ensure that all images, details, descriptions, stock inventory and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. Occasionally we will need to contact you to inform you of a stock discrepancy in our system, we will try our best to accommodate you when these errors occur at the discretion of Neverland Store.

The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies

Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

Delivery

We aim to deliver the Product to you at the place of delivery requested by you in your Order.

We aim to deliver within the time indicated by us at the time of your Order (and updated in the Confirmation of Order) but we cannot promise an exact date when you submit your Order or at the Confirmation of Order. We always aim to deliver within 3 working days from the date of any Order which we accept but we cannot guarantee any firm delivery dates.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

Unless otherwise specified, all risk in the Product shall pass to you upon delivery, except that, where delivery is delayed due to a breach of your obligations under a Contract, risk shall pass at the date when delivery would have occurred but for your breach. From the time when risk passes to you, we will not be liable for loss or destruction of the Product.

On occasion, technical and other problems may delay or prevent delivery of a particular Product. Except to the extent that applicable law provides otherwise, your sole and exclusive remedy with respect to any Product that is not delivered within a reasonable period will be either replacement of such Product or a refund of the purchase price paid for such Product, as determined by us in our sole discretion.

Non receipt of parcel due to Third Party influence

From time to time, external factors within the delivery network of all third party couriers can create delays with shipping.

Generally if after 5 business days you have still not received your parcel we will contact our couriers to open an investigation. This process can take up to 7 business days. At the discretion of Neverland Store, if your parcel has still not been delivered by the end of this process, or within an acceptable timeframe, we will be more than happy to re-ship your item/s or refund your order (please note this does not apply to orders where the address has been submitted incorrectly at the point of Checkout).

We thank you in advance for your understanding as once the parcel is with a third party courier network we do require time to both open and complete an investigation and wait for any potential delays within the network to be resolved. We will always work to resolve a lost parcel enquiry within 10 business days once the enquiry has been brought to our attention.
